DONATION, INTERNATIONAL SUPPORT, AND CHARITABLE CONTRIBUTION POLICY

General Provisions
1.1. This Donation, International Support, and Charitable Contribution Policy regulates the process of providing voluntary financial, material, technical, humanitarian, informational, and other forms of support for the ATEY Special Operations Battalion of the National Guard of Ukraine through the atey.army website, official social media pages, partner resources, or through authorized representatives and partners of the unit.
1.2. By using the atey.army website, making a charitable contribution, transferring funds, donating equipment or property, or providing any other form of support, the user or donor confirms that they have read this Policy, understand its contents, and agree to all of its terms.
1.3. All forms of support are entirely voluntary and are provided at the initiative of the donor without coercion, guarantees, compensation, or obligations from the ATEY Battalion, its representatives, volunteers, or partners.
1.4. The ATEY Battalion is a combat unit of the National Guard of Ukraine carrying out missions related to national defense, protection of strategic facilities, counter-sabotage operations, combat activities, reconnaissance, UAV operations, robotic systems, and other security-related tasks connected to the defense of Ukraine.
1.5. Support may be provided by citizens of Ukraine, foreign nationals, members of the Ukrainian diaspora, international charitable organizations, religious institutions, public organizations, private companies, volunteer initiatives, and other individuals or entities that do not violate the laws of Ukraine or international law.
2 Voluntary Nature of Support
2.1. Any charitable contributions, donations, fund transfers, or property transfers are made exclusively on a voluntary basis.
2.2. The donor confirms that they:

act voluntarily and knowingly;

have the legal right to dispose of the funds or property;

do not violate the laws of their country of residence;
-
are not subject to sanctions or other international restrictions;
-
do not finance terrorist, criminal, or other prohibited activities.
2.3. Charitable contributions are not:

payment for goods or services;
-
investments;
-
a form of lending;
-
a deposit;
-
a service agreement;
-
a guarantee of reciprocal actions;
-
grounds for employment, contractual, or partnership relationships.
2.4. All contributions are considered non-refundable voluntary support unless otherwise explicitly stated in separate written agreements.
3 Use of Charitable Support
3.1. Received funds and material resources may be used for:

combat operations support;
-
procurement of UAVs;
-
purchase of vehicles;
-
acquisition of robotic systems;
-
communication equipment;
-
generators;
-
power systems;
-
medical and tactical medical supplies;
-
ammunition and tactical gear;
-
equipment procurement;
-
vehicle and equipment repairs;
-
logistics support;
-
training of personnel;
-
informational and technical support;
-
humanitarian needs;
-
maintenance of official informational resources;
-
organizational and administrative needs related to unit activities.
3.2. The ATEY Battalion, its representatives, partners, or volunteers reserve the right to independently determine priorities for the use of received support according to operational needs, battlefield conditions, and security factors.
3.3. In the event of changes in operational conditions or unit priorities, funds may be redirected toward other critically important needs without separate approval from the donor.
3.4. Part of the support may be used through partner volunteer or charitable organizations, international initiatives, or other authorized persons to ensure continuity of logistics and procurement.
4 International Support and Currency Transactions
4.1. The atey.army website and related initiatives may receive international support, including foreign bank transfers, humanitarian aid, equipment, technical systems, and other forms of assistance.
4.2. Donors are independently responsible for complying with currency, tax, and other legal requirements of their country of residence.
4.3. The administration of the resource shall not be responsible for:

bank fees;
-
currency restrictions;
-
delays in international transfers;
-
blocked transactions by payment systems;
-
financial monitoring by banks;
-
actions of third parties or foreign government authorities.
5 Privacy and Security
5.1. Due to martial law conditions, security requirements, and the military nature of operations, certain information regarding the use of support may not be publicly disclosed.
5.2. The administration of the resource reserves the right not to disclose:

logistics routes;
-
exact locations where equipment is used;
-
the quantity of received equipment or supplies;
-
personal data of servicemen;
-
internal organizational information;
-
other information whose disclosure may create risks to personnel safety or mission execution.
5.3. Photos, videos, reports, and publications on the website or social media are informational in nature and do not constitute official financial or accounting reporting.

Limitation of Liability
6.1. The administration of the atey.army website, representatives of the ATEY Battalion, volunteers, partners, and other involved parties shall not be liable for:

technical errors;
-
website interruptions;
-
loss of access to services;
-
actions of third parties;
-
banking or payment errors;
-
transfer delays;
-
force majeure circumstances;
-
consequences of combat operations;
-
cyberattacks;
-
communication or power outages.
6.2. All information on the website is provided on an “as is” basis without guarantees of uninterrupted operation, accuracy, or availability.
7 Prohibited Sources of Support
7.1. The administration of the resource reserves the right to refuse support without explanation in cases where:

the origin of funds raises concerns;

the support may violate the laws of Ukraine or international law;

the donor is connected to sanctioned, terrorist, or hostile structures;
-
the support may create security, legal, or reputational risks.
8 Force Majeure
8.1. Parties shall not be held liable for failure or partial failure to fulfill obligations in the event of force majeure circumstances, including:

combat operations;
-
terrorist acts;
-
cyberattacks;
-
power outages;
-
communication disruptions;
-
government decisions;
-
emergency situations;
-
other circumstances beyond reasonable control or prediction.

10.1. The administration of the atey.army website reserves the right to amend this Policy without prior notice to users.
10.2. The current version of the Policy becomes effective from the moment of publication on the website.
10.3. Continued use of the website or provision of charitable support after updates to the Policy constitutes confirmation of the user’s agreement with the updated version of the document.
10.4. All legal relations related to the use of the atey.army website and the provision of charitable support shall be governed by the laws of Ukraine and applicable norms of international law.
